We represent and advise clients who are or might become involved in a lawsuit or appeal as a result of a dispute. Attorney's Fees are usually a key issue in collections cases. In some smaller cases, the attorney's fees and other costs of collection may exceed the amount in controversy, in which situation it would not be collected from the other party. The general rule under Florida Law is that the prevailing party is only entitled to collect attorney's fees from the losing party if the contract between the parties allows for the recovery of attorney's fees, or if there is a statute which allows for the recovery of Attorney's Fees. In many cases, we recommend that our clients include an attorney's fees provision in their contract with their customers.
